These terms define the rules for using SMSPort, operated by DOMINARK DIGITAL PRIVATE LIMITED, including platform access, customer responsibilities, and service limitations.

SMSPort is a business messaging platform designed for onboarding WhatsApp assets, operating inbox and campaign workflows, and managing customer communication through a shared SaaS environment. These terms apply to all customer workspaces, users, and administrators using the service.

1. Acceptance of Terms

  • These Terms of Service govern access to and use of SMSPort by customer businesses, workspace members, and anyone acting on their behalf.
  • By accessing the platform, creating an account, or using any SMSPort features, you agree to these terms and to any policies referenced by them.
  • If you use the platform on behalf of a business, you confirm that you have authority to bind that business to these terms.

2. Platform Services

  • SMSPort provides software for onboarding WhatsApp Business assets, managing templates, handling inbox workflows, running campaigns, configuring automation, and managing related operational settings.
  • Some features depend on third-party platforms, including Meta and WhatsApp, and may be subject to their separate terms, policies, and technical limitations.
  • SMSPort may add, improve, limit, or retire features as part of ongoing product operations, maintenance, compliance, or security work.

3. Customer Responsibilities

  • Customers are responsible for the accuracy of their workspace information, member access, business assets, contacts, messaging content, and campaign activity.
  • Customers must ensure that they have the legal right and required consent to contact recipients and to use any data uploaded into the platform.
  • Customers must comply with applicable law, Meta and WhatsApp policies, anti-spam requirements, and any industry-specific rules relevant to their messaging activity.

4. Acceptable Use

  • You may not use SMSPort for unlawful, deceptive, abusive, harmful, or unauthorized activities, including spam, fraud, harassment, or attempts to bypass platform safeguards.
  • You may not interfere with platform security, reverse engineer protected functionality, or use the service in a way that harms system integrity or other customers.
  • SMSPort may suspend or restrict access where misuse, policy violations, security threats, or legal risks are detected.

5. Third-Party Services and WhatsApp

  • Use of WhatsApp Business Platform features depends on Meta systems, approvals, configuration, business verification, template review, billing state, and sender quality.
  • SMSPort is not responsible for third-party outages, policy enforcement decisions, app review delays, account restrictions, or platform-side billing issues imposed by Meta or other providers.
  • Customers remain responsible for maintaining any required third-party accounts, approvals, payment methods, and credentials needed for their messaging operations.

6. Billing and Plans

  • Access to certain features may depend on the plan assigned to the workspace, usage limits, billing status, or commercial agreements.
  • SMSPort may apply limits relating to seats, conversations, automation features, integrations, AI access, or operational capacity based on the active plan.
  • Failure to maintain required billing or third-party payment obligations may result in restricted access, paused services, or suspension of certain features.

7. Availability and Support

  • SMSPort aims to operate reliably, but uninterrupted availability is not guaranteed.
  • Maintenance, third-party outages, infrastructure incidents, security events, or provider-side changes may affect service availability or functionality.
  • Support response times and escalation paths may vary based on plan level, severity, and the nature of the issue.

8. Termination

  • Customers may stop using the platform at any time, subject to any commercial obligations or active subscription terms.
  • SMSPort may suspend or terminate access where necessary to enforce these terms, protect the platform, respond to abuse, or meet legal or provider obligations.
  • Termination does not remove any responsibility for charges, violations, or obligations that arose before access ended.

9. Liability and Changes

  • SMSPort is provided on an as-available basis. To the maximum extent allowed by law, warranties not expressly stated are excluded.
  • SMSPort is not liable for indirect, incidental, consequential, special, or business-interruption losses arising from use of the platform, third-party failures, or customer misuse.
  • We may update these terms from time to time. Continued use after updated terms take effect means the updated terms are accepted.
